Theft of property valued at $1,000 or more is a felony in Colorado, while theft of property valued at less than $1,000 is a misdemeanor. The same valuation applies for criminal mischief. Burglary is considered a crime against property and is always charged as a felony.

Defenses in Theft Cases

There are defenses in theft crimes. One is that you thought you had a right to the item you are accused of taking. Police must prove that you intended to commit a crime, and in some cases that can be difficult to do.

I represented a client who was charged with theft by receiving when she was arrested driving a stolen car. I successfully argued that my client had been given the car by her boyfriend and did not know it was stolen.

Many Colorado counties offer diversion programs for first-time offenders, which would allow you to resolve the charges without a criminal conviction.
