Boulder Drug Crime Defense Lawyer

Being arrested for a drug crime can have a huge and permanent negative effect on your life. In addition to criminal penalties, you may also be subject to civil forfeiture laws that allow the government to take your property. You could lose your car, your money and even your home if law enforcement believes it is used, intended for use or represents proceeds traceable to illegal drugs. You can also lose your right for financial school aid.

I am lawyer Marc Milavitz. I defend people charged with all types of criminal offense, including drug crimes. I also help people with prior drug convictions clear their criminal records whenever that is possible. While I am located in Boulder, I handle major cases across Colorado and the United States.

I am a member of NORML and represent many individuals charged with possession, distribution and cultivation of marijuana. I am familiar with all issues and defenses related to Colorado medical marijuana laws. I also handle cases involving cocaine, crack cocaine, powder cocaine, meth, ecstasy, LSD, heroin, prescription drugs and other illegal drugs.

Defenses in Drug Cases

Many Colorado counties offer diversion programs, drug courts or treatment courts that can sometimes allow you to resolve the charges without jail time or a criminal conviction. These programs focus on treatment rather than punishment for drug users and addicts. To put yourself in a better position to take advantage of alternative programs, I often encourage my clients to enroll in drug treatment programs right away. The justice system will most likely treat you better if you take a proactive approach to treatment.

I also have extensive experience raising defenses based on illegal police conduct and constitutional issues related to the stop, search warrant, wiretap, and search and seizure of drug evidence. These issues can lead to a better plea bargain or even dismissal of your case.

I have successfully tried major drug cases in state and federal courts, including United States v. Brian Gall, a landmark ecstasy case that established an important rule favoring defendants in federal sentencing law. I was Mr. Gall's trial attorney and a key member of the appellate team that won at the United States Supreme Court and resulted in a non-prison sentence for Mr. Gall.
